By purchasing and/or using our services you agree to the terms below. Please read them carefully. These terms may be updated at any time, the current version will be available on this website.
30-Day Refund Policy: If within 30 days you decide Iris Market Builder is not right for you, you can request a refund by opening a support ticket (email support@elementalmuse.com) and requesting a refund and cancellation of your account. You will receive a refund within 48 hours. If you paid by credit card, we will refund the credit card and send you the transaction code. If you paid with PayPal, you will receive a refund through PayPal. There will be a $30 installation fee deducted from the refund. Charges for custom template integration are non-refundable.
Cancellation After 30 Days: No refunds will be issued for cancellations after the first 30 days. But there are no cancellation fees and you are not locked into any contracts, so you can cancel anytime.
Right to Cancel or Reject Order: We reserve the right to cancel an account. If you violate our acceptable use policy your account will be cancelled without refund (see below for further details). We also reserve the right to reject any accounts for a variety of reasons. Our goal is to keep our server family-friendly and running smoothly for all our clients so we do screen new clients.
Cart Modifications: If third party modifications are made to the Iris Market Builder system we cannot guarentee their function or continued support. We cannot upgrade carts with modifications. If you have specific functionality you need please contact us directly and we will work with you to help you find a programmer familiar with the cart to make modifications.
Designers: We are not responsible for the work of any designer you hire to work on your cart. You will need to read their policies and work directly with them to resolve any design related issues.
Mal's E-Commerce: Iris Market Builder *requires* an account with www.mals-e.com and will not work as an e-commerce solution without a Mal's account. We provide limited support to help you setup your Mal's account to work with your shop. For advanced support such as payment processor connections we are happy to provide help where possible but may refer you directly to Mal's. Visit Mal's website and make sure that the checkout options there will work for your needs if you have particular taxes you need setup, a certain payment processor to use, or specific shipping setup. It has a great range of options for these areas, but you may need a premium account for certain payment processors or shipping APIs.
Payment Processors for Shops: Many payment processors can be setup and configured to work with Mal's checkout system. We do not provide support for these payment processors or for merchant accounts. You will need to contact your merchant account or processor directly with questions about deposit times, terms of use and service, and related issues.
About Iris Market Builder: Iris Market Builder is privately branded version of Option Cart's Site Builder. We are not the developers/programmers. We have branded it as Iris Market Builder for marketing purposes only.
Payment Terms: Billing for Iris Market Builder is through Elemental Muse, our parent company. We accept PayPal payments, Visa, or Mastercard. You will receive a notice 7 days prior to your due date, another reminder 2 days prior, and then a late payment notice when your account is overdue. At 15 days past due the account may be suspended. At 30 days past due the account may be terminated and deleted. We will make every effort contact you prior to suspending or cancelling any accounts. Please be sure your contact email address is up to date in the client billing area.
Acceptable Use Policy: Any account found to be in violation of acceptable use may be terminated without refund or notice. We do not allow adult materials, pornography, warez, pirated software, or any illegal materials on our servers. This includes copyrighted music or images. Do not use images or text which you do not have the rights to or permission to use. This includes hot-linking images from other websites without permission. It also includes copying product images or descriptions without written permission. If we receive a complaint, we will request verification of infringement and if the verification provided shows that copyright infringement has occurred, we will contact you immediately in an attempt to resolve the situation. If you are violating a copyright we have no choice but to access your account to remove the infringing materials and/or suspend your account pending your response at our discretion. We will resolve copyright infringement on a case by case basis and we reserve the right to remove materials upon receiving a complaint or notice of copyright infringement and/or suspend or terminate an account in copyright violation.
